Is Snus Legal? EU, UK, Germany & Spain (Nov 2026)
Is snus legal? Tobacco snus is banned for sale in the EU except Sweden; nicotine pouches follow national rules. Country-by-country status as of November 2026.
Is snus legal? It depends on which product you mean and where you are. Traditional tobacco snus may not be sold anywhere in the European Union except Sweden, and it is also banned for sale in the UK. Tobacco-free nicotine pouches — which many people also call “snus” — are not covered by that ban, so each country decides for itself: they are sold openly in some places, restricted in others and banned in a growing number.
This guide sets out the legal position as of November 2026, with links to the laws, court decisions and government statements we relied on. It is general information, not legal advice. Laws in this area are changing quickly — several of the rules below were adopted or proposed in the last twelve months — so always check the current rules of the country you are in.
First: “snus” means two different things
Most of the confusion around “is snus legal” comes from the word itself. Lawmakers treat these two products completely differently:
- Snus (tobacco) — moist ground tobacco, loose or in pouches, the traditional Swedish product. Legally it is “tobacco for oral use”.
- Nicotine pouches — white pouches with plant fibre, nicotine, flavourings and fillers but no tobacco leaf. Brands like VELO and ZYN fall into this group. Everything Snuseli sells is in this category.
If you want the full background on the products themselves, read nicotine pouches vs snus. For the legal question, the key point is simple: the EU-wide ban is written for tobacco, so it does not automatically catch tobacco-free pouches.
The EU snus ban: what the law actually says
The rule sits in the EU Tobacco Products Directive (Directive 2014/40/EU). Article 17 reads: “Member States shall prohibit the placing on the market of tobacco for oral use, without prejudice to Article 151 of the Act of Accession of Austria, Finland and Sweden.” That reference to the Act of Accession is Sweden’s exemption, negotiated when it joined the EU in 1995, which is why snus is sold freely in Swedish shops but not in Germany, Spain or France.
Two things are worth noticing. First, the ban targets placing on the market — selling and supplying — not the person using it. Second, the ban has been challenged and upheld: in case C-151/17 (Swedish Match v Secretary of State for Health) the Court of Justice of the EU confirmed in 2018 that the prohibition is valid. So when people ask “why is snus banned in the EU?”, the short answer is that EU lawmakers chose to stop a new oral tobacco market forming outside Sweden, and the courts accepted that choice.
Why are nicotine pouches treated differently?
Because there is no tobacco in them, nicotine pouches are not “tobacco for oral use”, and the Tobacco Products Directive has no specific chapter for them. That gap has been filled country by country, and in very different ways: some countries treat pouches as ordinary consumer products, some as food, some as tobacco-related products with their own limits, and some ban them. At EU level, a proposal from July 2025 to revise the Tobacco Taxation Directive would bring nicotine pouches into the EU excise system for the first time; as of November 2026 that is still being negotiated.
Country by country (as of November 2026)
| Country | Tobacco snus | Nicotine pouches |
|---|---|---|
| Sweden | Legal to sell (EU exemption) | Legal to sell |
| Germany | Sale banned (EU ban) | Rules vary across the EU and are evolving |
| Spain | Sale banned (EU ban) | Sold; bill in parliament would regulate them as tobacco-related products |
| France | Sale banned (EU ban) | Banned since 1 April 2026 (import, possession, sale) |
| Netherlands, Belgium | Sale banned (EU ban) | Sale banned |
| United Kingdom | Sale banned since 1992 | Legal; age of sale 18 from 29 October 2026 |
The details behind each line follow.
Germany
Tobacco snus is covered by the EU ban, implemented in German tobacco law, so it may not be sold in Germany. For tobacco-free nicotine pouches there is no EU-wide rule: as with other member states, rules for nicotine pouches vary between EU countries and are still evolving. Check the current rules where you live.
Spain: is snus legal in Spain?
Tobacco snus cannot be sold in Spain because of the EU ban. Nicotine pouches are currently sold, and new rules have been proposed. On 11 September 2026 the Spanish Congress published the government bill amending the tobacco law, Ley 28/2005 (BOCG, Series A, No. 111-1). In the bill, nicotine pouches are defined as tobacco-related products; under-18s would be barred from using them; sale would be limited to specialised shops; advertising, promotion and sponsorship would be banned; and cross-border distance selling of related products would be a serious infringement. The bill also lists the marketing of oral tobacco as a serious infringement. It is still going through parliament.
Separately, the Ministry of Health has put out for consultation a draft royal decree that would cap nicotine at 0.99 mg per pouch. That is a draft, not a law in force. For context, most pouches on the European market today are several times stronger — see our nicotine strength chart.
France
France adopted Decree No. 2025-898 of 5 September 2025 banning oral nicotine products — pouches, beads, gums and liquids that are not medicines. According to the official French public-service site, the ban on import, possession, offering and transfer applies from 1 April 2026. The Conseil d’État suspended only the parts on manufacturing and export while it rules on the case.
Netherlands and Belgium
The Dutch government announced a ban on the sale of all nicotine pouches in April 2023, and Belgium has also banned sales.
United Kingdom: is snus legal in the UK?
Tobacco snus has been banned for sale in the UK since 1992. Nicotine pouches are legal and until now have been covered only by general product safety law. According to Action on Smoking and Health (ASH), the Tobacco and Vapes Act introduces an age of sale of 18 for nicotine pouches from 29 October 2026, together with a ban on free distribution (also confirmed in GOV.UK guidance).
Buying vs. carrying vs. using
Legal texts usually distinguish between three acts, and the answer can differ for each:
- Selling / placing on the market — the main target of the EU snus ban.
- Importing and possessing — normally not addressed, but France now prohibits it for oral nicotine products, and some countries set quantity limits.
- Using — may be restricted in places where smoking is banned or for minors (as in Spain’s bill).

Our view
We are a Swedish-based shop, so we see the contrast every day: what is an everyday product in Stockholm is regulated very differently elsewhere, and banned in France. We think readers are best served by plain facts, not by marketing claims that pouches are “legal everywhere in the EU” — they are not. We only deliver to the markets listed in our shipping policy, sell to adults 18+ only, and we will update this page as the Spanish bill, the EU tax revision and other rules move forward.
Legal status also says nothing about safety. Nicotine is addictive, and Germany’s Federal Institute for Risk Assessment (BfR) has highlighted particular risks for young people, non-smokers, pregnant and breastfeeding women and people with cardiovascular disease. FAQ
Is snus illegal in the EU?
Selling tobacco snus is prohibited in every EU member state except Sweden under Article 17 of Directive 2014/40/EU. The directive targets placing on the market, not personal use.
Why is snus banned in the EU but not in Sweden?
Sweden secured an exemption in its 1995 Act of Accession because snus was a traditional product there. The EU Court of Justice upheld the ban for the rest of the EU in case C-151/17.
Is snus legal in Germany?
Tobacco snus may not be sold. For tobacco-free nicotine pouches, rules vary between EU countries and are still evolving (as of November 2026).
Is snus legal in Spain?
Tobacco snus cannot be sold. Nicotine pouches are sold, but a bill published on 11 September 2026 (BOCG-15-A-111-1) would regulate them as tobacco-related products, restricting where they can be sold and banning advertising.
Is snus legal in the UK?
Tobacco snus has been banned for sale since 1992. Nicotine pouches are legal for adults, with an 18+ age of sale from 29 October 2026.
